The following terms govern the sale of products listed on this website by mini by luna,lda  with registered office in Av.Infante Santo 17, 6ºDto Lisboa and Tax ID number 510280978 (hereinafter MBL), to the customer or user (hereinafter the Customer or USER) as well as the use thereof. By browsing on the online shop and purchasing any products listed, the user accepts, with no reservations of any kind, each and every one of these general terms and conditions. MBL may at any time and without notice amend these general terms and conditions, as well as any special conditions included, by posting these amendments on the store for users’ information. The date of these modifications will remain on record and all laws and regulations in force will be complied with at all times. The products offered on this website, and specifically the prices, specifications, promotions and any other information may change without notice.

 

1. Ownership of the Website Content.

 All content published in the store, and especially designs, text, graphics, photographs, images, logos, icons, buttons, as well as software, trade names, trademarks or industrial drawings and any other symbols subject to industrial and commercial use are considered MBL intellectual property and under copyright, and are the exclusive property of MBL Under no circumstances shall it be understood that MBL grants any licence whatsoever or issues any waiver, transfer (total or partial) of such rights, nor any right or expectation of rights conferred, in particular for the alteration, exploitation, reproduction, distribution or public communication of these contents without prior express authorization from MBL

 MBL shall not be liable, in any case and under any circumstances, for violations of such rights committed by the USER.

4. Purchase Warranties

Items offered on this website meet the same quality and warranty requirements as products offered for sale in retail outlets.

Each product is listed with the following information

* MBL has made an effort to display product colours as close to reality as possible. Nevertheless, the colour of products shown on screen may vary depending on the quality of your computer monitor. MBL can therefore not guarantee that the colour of the product you receive matches exactly the colour shown on your screen.

Special offers, promotions and discounts will be valid until the date shown or until stocks run out.

 

5. Purchase Procedure

To checkout you have to be a registered user. Once you register, and to proceed with your purchase, you must add the product you wish to purchase to the MBL cart, according to the on-screen instructions. Fill out and confirm the order form. By confirming the order, the client expressly undertakes to know and accept these General Terms and Conditions as part of the contract. 

 

5.1 Order

Select the items you wish to purchase and add them to the shopping cart by clicking on the corresponding icon. The shopping cart will show the part number of the selected item, its name and price. Applicable taxes will be detailed separately in addition to the shipping charges that may apply depending on your destination country.

The order form will request your personal data, which will be added to our database in order for BML to process your order and allow you to continue shopping on the site. You may access your personal data. Remember that your personal data must be entered accurately to avoid confusion or issues with the shipping of items purchased. Furthermore, should you request it, you will receive MBL information and publications by post and/or e-mail.

Once the order is completed and prior to shipping, a summary will be issued listing the item purchased, the total price (including transport and taxes) and shipping details. The order must be confirmed by clicking the "Confirm Order" button. 

 

5.2 Pricing and Currency

All prices published by MBL in the shop include indirect taxes (Value Added Tax), if you specified an EU country in your shipping address in the initial settings.

As a general rule, the Value Added Tax applicable for the territory of the European Union where this tax applies will be the current tax rate in Portugal. Companies in EU countries, except Portugal, shall be exempt from paying this tax.

Mini by luna, LDA presents and sells the products in euros.  

 

5.3 Payment Method 

Purchases are paid by secure credit card or debit cards or Easy Pay. No other forms of payment are accepted.

Credit card or debit card payments will be online, i.e., in real time.

Specifically, MBL offers the following payment methods:

 

a) VISA, MASTERCARD, MAESTRO Credit Cards

We guarantee that every transaction made by MBL is 100% secure. All operations involving the transfer of personal or banking data occur in a secure environment.
 MBL uses a server based on standard SSL (Secure Socket Layer) technology. All information you send us travels encrypted through the network, and your credit card data are not registered in any database but go directly to the POS (Bank Point of Sale). 

If you have not yet received a personal password used exclusively for online payments, we suggest you ask your financial institution to link your cards to the Secure Electronic Commerce system.

Once you enter your data, the operation is sent to the card issuer, who confirms the authentication of the operation. The card issuer therefore checks the card holder’s authenticity.

 

b) EasyPay:

EasyPay allows consumers to make payments online securely, easily and cost-effectively. The EasyPay network builds on the existing financial infrastructure of bank accounts and credit cards to create a global payment solution in real time.

5.4 Order Delivery. Shipping Fees.

The price of products will be as stipulated at all times on our website.

All prices are listed in EUROS. The prices listed on the website include 23% VAT, exclude shipping costs.

Prices may change at any time, but will not affect orders for which we have already sent a shipping confirmation.

Items purchased at MBL will be delivered through a courier company. Delivery times are generally a maximum of 12 working days. Such turnarounds may vary depending on the specific circumstances of each order, such as product availability and shipping area. Also, under exceptional circumstances, that period may be affected by extraordinary carrier incidents or difficulties in delivering the goods. In these cases, the delivery time can be up to 30 working days.

To avoid delivery issues (incorrect addresses, no one found at home etc.), the shipping form must be completed accurately and telephone contact information must be included.

MBL responsibility is limited in cases of force majeure (strikes, adverse weather conditions hindering normal traffic by land, sea or air, etc.). In these cases, MBL will deliver the orders as soon as possible and the above limits will not apply.

Our carriers attempt delivery up to 2 times at the address provided by the customer during normal working hours (9 am to 6 pm). It is the customer’s responsibility to be present at the delivery address provided to MBL. In the event that delivery cannot be made for failure to find the customer at the specified address, the carrier will return the package to the sender and MBL.

 

6. Purchase Limit

MBL does not allow the purchase of MBL products for resale.

8. Right of Withdrawal

You are entitled to withdraw from this contract within 14 calendar days without need for justification.

The withdrawal period will expire after 14 calendar days from the day you or a third party indicated by you, other than the carrier, has acquired the physical possession of the goods.

To exercise the right of withdrawal, you must notify mini by luna,lda at  Rua Dom Pedro V, 74 , 1250-094 Lisbon(Portugal), phone 00351 213465161 or  info@minibyluna.com, of your decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post,  or e-mail including a copy of the original invoice). You may optionally use the withdrawal form below.

To meet the withdrawal period, it is sufficient that your communication concerning the exercise of your rights is sent before the expiry of the deadline.

Effects of withdrawal

In the event of withdrawal, we will refund all payments received from you, exclusing shipping costs without undue delay and in any event no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will issue the reimbursement using the same payment means you used for the initial transaction or by bank transfer unless you have expressly specified otherwise. In any event, you will not incur any reimbursement-related fees. We may withhold reimbursement until we receive the goods.

The right of withdrawal will not be applicable to contracts that refer to:

a) The supply of goods prepared in accordance with the specifications of the consumer and user or clearly personalized.

b) The supply of goods that may deteriorate or expire quickly.

c) The supply of presealed goods that are not suitable to be returned on grounds of the protection of health or hygiene and whose seals have been broken after delivery. ( ex.cosmetics, lingerie, swimwear)

d) The supply of goods in sales or with any discount.

You must return or deliver goods directly at mini by luna,lda, main store Rua Dom Pedro V, 74 1250-094 (Portugal), phone 00351 213465161 or  info@minibyluna.com  without undue delay and in any event, no later than 14 calendar days from the date on which you communicate your decision to withdraw from the contract. The deadline will be considered as met if you send back the goods before the period has ended. You must bear the direct cost of returning the goods.

Only you are responsible for the diminished value of the goods resulting from handling them in a way other than what is strictly necessary to establish the nature, characteristics and operation of the goods.

9. Returns of defective products

In the cases in which you consider that at the moment of delivery the product is not as stipulated in the Contract, you must contact us immediately by e mail info@minibyluna.com, providing the product details, copy of invoice and the damage sustained, or calling us on 00351 213465161, where we will indicate what you need to do. You can return the product at our Lisbon Store in Portugal. You must return the product together with the original invoice that you will receive with the product when it is delivered. We will carefully examine the returned product and will notify you by e-mail within a reasonable period if the product may be refunded or replaced (as appropriate). The refunding or replacement of the article shall take place as soon as possible and in all cases within 14 days from the date on which we send you an email confirming the that refund or replacement of the product is going ahead. The amounts paid for the products returned due to any damage or defect, when it actually exists, will be reimbursed in full, including the delivery costs related to sending the article and the costs to you for returning it to us. The refund shall be paid by bank transfer. All rights recognised in current legislation shall be, in any case, safeguarded.

 

10. Miscellaneous

MBL is thus committed to not carrying out false advertising. Formal or numeric errors in the content of the various sections of our online store cannot be considered false advertising when resulting from incomplete or faulty maintenance and/or updating of information in these sections. Pursuant to the provisions of this paragraph, MBL undertakes to correct any errors as soon as it becomes aware of them.

Users who sign up through the online shop declare they are of full legal age. Purchases carried out by minors requires prior authorization from parents, guardians or legal representatives, who will be held liable for purchases made by the children in their care. Minors must obtain the necessary consent prior to making any purchases.

 

11. Law and Applicable Jurisdiction

These purchase conditions are subject to the portuguese legislation, so sales transactions are deemed to be performed in MBL registered office.
